Agreement
These Terms of Service (“Terms”) govern your use of the Amerka Travel website and any travel services you book with Amerka Travel (“Amerka,” “we,” “us,” or “our”), a travel agency based in Boston, Massachusetts. By browsing our site, submitting an inquiry, or booking a trip with us, you agree to these Terms.
If you book on behalf of other travelers, you confirm that you have their permission to do so and that you accept these Terms on their behalf.
Our role as travel agency
Amerka Travel acts as an independent agent arranging travel services provided by third parties, including airlines, hotels, ground transport operators, visa-processing services, and tour operators (“Suppliers”). Each Supplier has its own terms, conditions, and policies, which also apply to your booking. We are not liable for the acts, omissions, defaults, or failures of any Supplier.
Booking & confirmation
- All bookings are subject to availability and confirmation by the relevant Suppliers.
- You must provide accurate, complete information, including names exactly as shown on travel documents. We are not responsible for costs caused by inaccurate or incomplete information.
- A booking is confirmed only when we receive your deposit (or full payment, where required) and issue a written confirmation.
Pricing & payment
- Prices are quoted in U.S. dollars and may change until the booking is fully paid. Quoted prices include only what is expressly listed.
- A non-refundable deposit is due at booking. The balance is due by the date stated on your invoice; failure to pay on time may result in cancellation and forfeiture of the deposit.
- Currency exchange rates, fuel surcharges, taxes, and government fees may change and may be passed through to you.
- Payments are processed by a third-party payment processor; you agree to its terms.
Traveler responsibilities
- Travel documents: you are responsible for valid passports (with sufficient validity), visas, vaccinations, and any other documents required for Umrah, Hajj, or other travel.
- Health & fitness: you confirm that you and all travelers in your booking are physically and mentally fit to participate in the program, including the demands of Umrah and Hajj.
- Conduct: travelers must behave respectfully and comply with local laws, religious customs, and the rules of Suppliers. We reserve the right to remove any traveler whose conduct endangers others or disrupts the group, without refund.
- Insurance: we strongly recommend comprehensive travel and medical insurance. Travelers proceed without insurance at their own risk.
Changes & cancellations by us
We work to deliver the itinerary as advertised, but Suppliers, weather, government regulations, and operational issues sometimes require changes. We reserve the right to modify itineraries, change accommodations to a comparable standard, substitute Suppliers, or cancel a trip when necessary. Where a trip is cancelled by us, you will be offered a comparable alternative or a refund of payments received for the cancelled portion, in line with our Refund Policy.
Changes & cancellations by you
Changes and cancellations requested by you are governed by our Refund Policy and by the terms of the underlying Suppliers. Some elements of your trip (airline tickets, hotel deposits, Saudi visa fees) are non-refundable from the moment they are issued.
Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, strikes, epidemics, pandemics, severe weather, airline failures, Saudi government decisions affecting Umrah/Hajj quotas or access, or other force-majeure events.
Limitation of liability
To the maximum extent permitted by Massachusetts law, Amerka Travel’s total liability arising out of or in connection with a booking shall not exceed the total amount you paid us for that booking. We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of enjoyment, profit, or opportunity. Nothing in these Terms excludes liability that cannot lawfully be excluded under Massachusetts law.
Intellectual property
The Amerka Travel name, logo, website design, photography, and itineraries are owned by us or our licensors and are protected by U.S. and international law. You may not copy, reproduce, or use them without our written permission, except for personal, non-commercial use of the website.
Website use
- Use the site only for lawful purposes and in line with these Terms.
- Do not attempt to gain unauthorized access, scrape, overload, or interfere with the site or its users.
- Information on the site is provided “as is.” We try to keep it accurate but do not warrant that it is error-free or up to date at all times.
Governing law & disputes
These Terms and any booking with Amerka Travel are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
